Jay Zuspan, Jr. These Terms of Use govern your access to and use of the Site, including browsing the portfolio, submitting inquiries, booking sessions, and purchasing prints, digital images, or licenses through our store. By using the Site or purchasing from us, you agree to these Terms. If you do not agree, please do not use the Site.

2. Ownership of Content and Copyright

All photographs, images, designs, text, and other creative content displayed on the Site are the original work of E. Jay Zuspan, Jr. and are protected by U.S. and international copyright law, unless otherwise noted. Copyright in all Content remains with us at all times, including after a print, digital file, or license has been purchased, unless a separate written agreement explicitly states otherwise.

You may not copy, reproduce, modify, distribute, publicly display, create derivative works from, or otherwise use any Content without our prior written permission, except as expressly permitted under a purchase or license described below.

3. Browsing and Portfolio Use

You are welcome to view the portfolio for personal enjoyment and to evaluate our work for potential booking or purchase. You may not:

• Download, screenshot, or save portfolio images for personal or commercial use without permission.
• Repost, mirror, or republish portfolio images on other websites, social media, print media, NFTs, or AI training datasets.
• Use any image to train, fine-tune, or prompt generative AI or machine learning models.
• Remove or alter any watermark, credit, or metadata embedded in an image.

4. Purchasing Prints and Digital Images

When our store is active, you may purchase physical prints, digital image files, or other products through the Site’s WooCommerce-powered shop, subject to the terms below.

4.1 License Granted on Purchase

Unless otherwise stated on the product listing or in a separate agreement, purchasing a print or digital image grants you a limited, non-exclusive, non-transferable license to display a purchased print in a private, non-commercial setting or use a purchased digital file for personal, non-commercial purposes, such as personal devices or personal social media posts with credit to the photographer.

4.2 What Is Not Included

• Use the image for commercial purposes, including advertising, merchandise, resale, product packaging, or book and album covers.
• Sublicense, resell, or redistribute the image or print.
• Alter, crop, or create derivative works from the image for public use.
• Claim authorship or copyright of the image.

4.3 Extended and Commercial Licenses

Commercial use, editorial use, extended reproduction rights, or exclusive licenses are available separately by request. Terms, pricing, and usage scope will be set out in a dedicated license agreement or invoice, which will govern over these general Terms for that specific transaction.

4.4 Print Quality and Fulfillment

Prints may be fulfilled by us directly or through a third-party print fulfillment partner. Colors, framing, and paper stock may vary slightly from on-screen previews due to differences in display calibration.

4.5 Payment

All payments are processed securely through our designated payment processor(s). We do not store full payment card details on our own servers.

4.6 Returns and Refunds

Because digital files and made-to-order prints are produced specifically for you, all sales are final except in cases of defective or damaged prints, reported within 7 days of delivery with photo evidence, or order fulfillment errors on our part. Refund or replacement requests should be sent to ep.esotericphotographer@gmail.com.

5. Third-Party Licensing of Images

From time to time, we may license select images to third parties, such as publications, galleries, brands, or other commercial users, separately from the Site’s retail store.

Any such licensing arrangement will be governed by a separate, individually negotiated license agreement specifying the scope of use, duration, exclusivity, territory, and fees. These Terms of Use do not grant any third-party licensing rights; they apply only to Site visitors and retail purchasers as described in Section 4.

6. Session Bookings and Client Images

If you book a photography session with us:

• A separate session agreement or model release will govern ownership, usage rights, and portfolio or publication permissions for images created during your session.
• These Terms of Use apply to your general use of the Site, including browsing, account access, and store purchases, but do not override the specific terms of your signed session agreement.
• Any conflict between a signed session agreement and these Terms will be resolved in favor of the session agreement for matters it specifically addresses.

7. User Accounts

If the Site allows you to create an account, such as for store purchases or order tracking:

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• We reserve the right to suspend or terminate accounts used in violation of these Terms.

8. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the Site, its store, or related systems.
• Interfere with the Site’s security features, WebGL rendering, or normal operation.
• Use automated tools, including bots or scrapers, to harvest images, prices, or content from the Site.
• Misrepresent your identity or affiliation when purchasing or licensing images.

9. Disclaimers

The Site and its Content are provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, secure, or error-free.

Product images, colors, and descriptions in the store are provided for guidance; actual prints may vary slightly as noted in Section 4.4.

10. Limitation of Liability

To the fullest extent permitted by law, E. Jay Zuspan, Jr. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of any product, including but not limited to loss of data, loss of profits, or business interruption, even if advised of the possibility of such damages.

Our total liability for any claim arising from a purchase shall not exceed the amount you paid for the specific product or license giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless E. Jay Zuspan, Jr. from any claims, damages, or expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or misuse of licensed or purchased Content.

12. Governing Law

These Terms are governed by the laws of the District of Columbia, USA, without regard to conflict-of-law principles. Any disputes arising from these Terms or use of the Site shall be resolved in the state or federal courts located in Washington, DC.
